NFORCD LTD – Comprehensive Policy Document
1. REFUND POLICY
1.1 Faulty or Damaged Items
- We issue refunds exclusively for items that are faulty or damaged upon receipt.
- We may request such items to be returned at the buyer’s expense, depending on the circumstances.
1.2 Return Window
- We offer a 30-day return policy. You have 30 days from the date you receive your item to initiate a return.
- Refunds must be requested within 14 days of receiving your item. Returns initiated after 30 days from delivery may be rejected unless otherwise mandated by applicable consumer protection laws.
1.3 Eligibility Criteria
- Condition: The item must be in the same condition you received it—unworn or unused, with original tags, and in its original packaging in good condition.
- Documentation: You must provide a receipt, order confirmation, or other proof of purchase.
- Exclusions: Items with obvious signs of use, damage caused by the buyer, missing parts, or lacking original packaging may be ineligible for a refund or subject to a partial refund at our discretion.
1.4 Non-Returnable Items
- Types of Items: Certain products cannot be returned, such as perishable goods (e.g., food, flowers, or plants), custom or personalized items, and personal care products (e.g., beauty or hygiene products).
- Hazardous Materials: We do not accept returns for hazardous materials, flammable liquids, or gases.
- Sale Items & Gift Cards: We do not accept returns on sale items or gift cards.
- Questions: If you have concerns about whether a specific item is eligible for return, please contact us before purchasing.
1.5 Return Process
- Initiation: To start a return, contact us at Sales@nforcd.com with your order number and reason for return.
- Approval & Instructions: If your return is approved, we will provide instructions on how and where to send your package.
- Unauthorized Returns: Items sent back to us without prior return authorization will not be accepted.
1.6 Return Shipping Costs
- Buyer Responsibility: In most cases—especially when the item is not defective or if you simply change your mind—you are responsible for all shipping costs, including any additional fees (e.g., customs or duties) to return the item to us.
- Non-Refundable: We do not reimburse or provide refunds for any return shipping costs or expenses we incur in receiving your returned item. Any additional charges (like courier fees or customs) that we must pay may be deducted from your final refund.
- Recommended Shipping: We strongly recommend using a trackable shipping method and purchasing shipping insurance. We are not responsible for returns that are lost or damaged in transit.
1.7 Inspection & Restocking Fees
- Inspection: Upon receiving your return, our team will inspect the item’s condition. If any part is missing, damaged, or shows signs of use, we reserve the right to refuse the return or adjust the refund accordingly.
- Potential Restocking Fee: In certain circumstances (e.g., returned item not in its original condition), a restocking fee may apply. This fee will be deducted from the total refund amount.
1.8 International Returns
- Customs & Duties: If you are returning an item from outside our home country, you are responsible for any customs or duties fees that may apply to the shipment.
- Processing Time: International returns can take longer to be received and processed. We will notify you as soon as we have inspected and finalized your return.
1.9 Refunds
- Approval or Rejection: Once your returned item is received and inspected, we will notify you of our decision.
- Refund Method: If approved, your refund will be automatically credited back to your original payment method. It may take additional time for your bank or credit card company to process and post the refund.
- Partial Refunds: In instances where items are returned not in their original condition (e.g., missing parts, stained packaging, or signs of use), we may issue only a partial refund to reflect the product’s reduced value.
1.10 Exchanges
- Process: The quickest way to exchange an item is to return the original item (once approved) and place a new, separate order for the replacement.
- Eligibility: Exchanges follow the same criteria as refunds—30-day window, item in unused condition, etc.
1.11 Cancellations
- Prior to Dispatch: You may request a cancellation before your order has shipped by emailing Sales@nforcd.com.
- After Dispatch: If the item has already been dispatched, the order cannot be canceled. However, upon receiving the item, you may initiate a return according to the terms of this policy.
1.12 Damages and Issues
- Inspection: Please inspect your order upon reception and contact us immediately if the product is defective, damaged, or if you received the wrong item.
- Resolution: We will work with you promptly to evaluate the issue and, when applicable, replace or refund the item.

2. OUR LIABILITY TO CONSUMERS
- We will be responsible for any foreseeable loss or damage you may suffer as a result of our breach of these Terms of Service (or the Contract) or as a result of our negligence. Loss or damage is foreseeable if it is an obvious consequence of our breach or negligence or if it was contemplated by you and us at the time the Contract was made.
- We will not be responsible for any loss or damage that is not foreseeable.
- We supply goods for domestic and private use. We do not warrant or represent that the Goods are fit for commercial, business, or industrial use (including resale), and we will not be liable for any loss of profit or business, interruption to business, or loss of business opportunity.
- All parts are for track and off-road use only and must be installed by a professional. If you receive any damaged parts, do not install; contact us immediately.
3. SPECIAL ORDERS
- Special Orders & Pre-Orders: These cannot be canceled or returned, as we cannot send them back to our suppliers.
- If you are unsure whether an item is considered a special or custom order, please contact us. We will do our best to inform you before purchase.
4. SHIPPING
- Shipping Costs: Shipping is free for most items made by “nforcd,” but there may be exceptions.
- Delivery Times: We strive for timely and high-quality delivery service but cannot be liable for delays or issues once the package is handed over to the courier.
- Out of Stock Items: We do our best to keep inventory statuses accurate. If an item is unexpectedly out of stock, we will notify you as soon as possible.
5. NFORCD LTD – DATA PROTECTION POLICY
Effective Date: 8 August 2024
5.1 Introduction
This Policy sets out the obligations of NFORCD LTD (registered in England under number 12597701; registered office at Red House Farm, Southam Road, Napton, Warwickshire, CV47 8NG) regarding data protection and the rights of customers and business contacts (“data subjects”) under applicable data protection law (including EU Regulation 2016/679 GDPR, the Data Protection Act 2018, and any successor legislation as relevant).
The procedures and principles outlined here must be followed at all times by the Company, its employees, agents, contractors, or other parties working on behalf of the Company.
5.2 Definitions
- Consent: Freely given, specific, informed, and unambiguous indication by a data subject agreeing to the processing of their personal data.
- Data Controller: An individual or organization that determines the purposes and means of personal data processing. Here, NFORCD LTD is the data controller.
- Data Processor: An individual or organization processing personal data on behalf of a data controller.
- Data Subject: A living individual identified or identifiable by personal data.
- EEA: European Economic Area (EU Member States, Iceland, Liechtenstein, Norway).
- Personal Data: Any information relating to an identified or identifiable natural person.
- Personal Data Breach: A breach of security leading to unauthorized or unlawful destruction, loss, alteration, disclosure, or access to personal data.
- Processing: Any operation performed on personal data (collection, storage, use, etc.).
- Pseudonymisation: Processing personal data so it can no longer be attributed to a specific individual without additional separate information.
- Special Category Personal Data: Personal data on racial/ethnic origin, political opinions, religion, trade union membership, health, sexual orientation, biometric, or genetic data.
5.3 Scope
We comply with data protection laws in both letter and spirit.
- Data Protection Officer (DPO): Mr. Daniel Spence (Sales@nforcd.com) is responsible for implementing this policy.
- Consult the DPO for questions regarding legal bases for data processing, consent, retention periods, privacy notices, subject access requests, personal data breaches, security measures, third-party sharing, data transfers outside the EEA, or significant new processing activities.
5.4 Data Protection Principles
Under GDPR, personal data must be:
- Processed lawfully, fairly, and transparently.
- Collected for specified, explicit, legitimate purposes.

5.7 Consent
- Must be freely given, specific, informed, and unambiguous.

- If we change processing purposes, new consent may be required if purposes are incompatible.

5.8 Specified, Explicit, and Legitimate Purposes
- We collect data for explicit, lawful purposes and do not process beyond these unless legally permitted or with data subject consent.

5.14 Data Protection Impact Assessments

5.15 Keeping Data Subjects Informed

5.16 Data Subject Access
- Data subjects may submit Subject Access Requests (SARs).
- We generally respond within one month.
- We may charge a fee for repetitive or excessive requests.
5.17 Rectification
- Data subjects can request we correct inaccurate or incomplete data.
- We do so within one month, extendable to two months if needed.
5.18 Erasure (“Right to be Forgotten”)
- Data subjects can request erasure under certain conditions (e.g., no longer needed, withdrawn consent).
- We comply unless we have a legal basis to keep the data.
5.19 Restriction of Processing
- Data subjects can request restricted processing in certain scenarios (e.g., disputed accuracy).
- We notify any third parties who received the data unless it requires disproportionate effort.
5.20 Data Portability

5.29 Transferring Data Outside the EEA
- We only transfer data outside the EEA with adequate protections (e.g., adequacy decisions, standard contractual clauses, binding corporate rules, or explicit consent).

- Suspected or actual breaches must be reported immediately to the DPO.
- We inform the ICO within 72 hours if a breach poses a high risk to data subjects.
- We also notify affected data subjects without undue delay.

6. PRIVACY POLICY
This Privacy Policy describes how nforcd.com (“we,” “us,” “our”) collects, uses, and discloses your personal information when you visit or make a purchase from our website (“the Site”).
